ZIGGI’S COFFEE SEASON OF LOVE "FREE ZIGGI'S FOR A YEAR" GIVEAWAY TERMS AND CONDITIONS

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Void where prohibited. By participating, entrants agree to be bound by these Giveaway Rules and the decisions of Ziggi’s Coffee Franchise, LLC, a Colorado limited liability company (“Ziggi’s”), which are binding and final on matters relating to this giveaway (the “Giveaway”). This Giveaway is subject to all applicable federal, state, and local laws.

ELIGIBILITY: Open only to legal residents of states where Ziggi’s is sold, who are 16 years of age or older. Employees of Ziggi’s and any affiliates of Ziggi’s are not eligible for entry.

TO ENTER: To enter for a chance to win, customers must visit a participating Ziggi’s Coffee location during the "Season Of Love" event, which will take place at all locations from 2/5/2025 through 2/14/2025. During the event, a customer must make a transaction using their Ziggi’s Rewards account to qualify as an entry. A transaction is required to use a Ziggi’s Rewards account, but no purchase is necessary to enter as customers can utilize the offer of the day (in some cases this is a free item) as their transaction. The entry period is during normal store hours during the dates of the Season Of Love event (2/5/25-2/14/25). Only entries made during this time using a valid Ziggi’s Rewards account (through mobile app, email and/or phone number) will be eligible. Creating a Ziggi’s Rewards account is free, and customers can sign up prior to or during the event before the transaction is made.

ALTERNATIVE METHOD OF ENTRY (Mail-In Entry): Participants may receive one (1) entry to the Giveaway without having to make a purchase or utilize a Ziggi's Rewards account by mailing a plain 3”x5” card with their complete name, complete mailing address, phone number (including area code), email address legibly printed or typed onto the card. Then, mail the 3”x5” card in a postage-affixed sealed envelope to: Ziggi’s Coffee Season Of Love Giveaway, 241 Welker Ave., Mead, CO 80542. Mail-in entries must be postmarked by Wednesday, February 12th, 2025, and received no later than Monday, February 17th, 2025, to be considered eligible. Sponsor will not verify receipt of entries for Participants. All entries submitted become the sole property of Sponsor and will not be returned. Sponsor is not responsible for late, misdirected, illegible, or damaged mailed entries.

Entries generated by script, macro or other automated means and entries by any means which subvert the entry process are void. Limit of one (1) entry per person throughout the Giveaway Period, regardless of method of entry. Entries received from any Participant in excess of the limitation stated above will be void.

ENTRY PERIOD/DRAWING: One (1) potential winner will be selected in a random drawing from all eligible entries received during the entry period. The entry period is from 2/5/2025-2/14/2025. A potential winner will be notified via the email associated with their Ziggi’s Rewards account within three (3) business days following the event. Ziggi’s will make two attempts to notify the winner. If the winner does not respond within two (2) business days, Ziggi’s reserves the right to draw an alternate winner. Non-winning entries will not be carried over into subsequent giveaways. Odds of winning depend on the number of eligible entries received by the end of the entry period.

PRIZE: One (1) winner will receive one (1) free 16 oz menu beverage per week for a total of 52 weeks, starting when the winner is awarded their first free drink. The free drink will expire at the end of each week (7 days) if not used. This prize is limited to drink items on the menu, excluding all other drink sizes, modifiers, food, bottled beverages, or retail items. Must be redeemed through a Ziggi’s Rewards account only. Prizes are non-transferrable and cannot be traded in for cash value. Offer details are subject to change without notice.

WINNER VERIFICATION: All potential winners are subject to verification by Ziggi’s, whose decisions are final and binding. An entrant is not a winner of any prize unless and until the entrant's eligibility has been verified.

PUBLICITY RELEASE: By accepting the prize, the winner agrees to allow Ziggi’s to use their name, likeness, and prize information for promotional purposes in any media without additional compensation, unless prohibited by law. This includes but is not limited to photographs taken at the prize redemption and the winner’s name being published on Ziggi’s social media channels and other marketing materials.

GENERAL CONDITIONS: Released Parties (as defined below) are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered, or garbled entries for any reason, or for other errors whether human, mechanical, electronic, computer, network, typographical, printing, or otherwise, relating to or in connection with the Giveaway, including, without limitation, errors that may occur in connection with the administration of the Giveaway, the processing of entries, the announcement of the prize, or in any Giveaway-related materials.

Entrants are prohibited from creating multiple or fraudulent Ziggi’s Rewards accounts or using any unauthorized methods to participate in the Giveaway. Ziggi’s reserves the right, in its sole discretion, to disqualify any individual found to be tampering with the entry process or the operation of the Giveaway, creating multiple accounts, acting in violation of these rules, or engaging in any other fraudulent or deceptive activity.

Given that this Giveaway occurs at a physical location, Ziggi’s is not responsible for any issues related to the point-of-sale system or the Ziggi’s Rewards program that may prevent an entry from being processed. This includes, but is not limited to, system outages, technical failures, or any other issues that prevent the completion of a transaction or the proper recording of an entry. In the event of such issues, Ziggi’s reserves the right, at its sole discretion, to suspend, modify, or terminate the Giveaway and, if terminated, to select the potential winner from all eligible, non-suspect entries received prior to the action taken, using the judging procedure outlined above.

Ziggi’s is also not responsible for injury or damage to participants or to any other person's computer or mobile device related to or resulting from participating in this Giveaway or downloading materials from or using the Ziggi’s website or app. Any attempt to deliberately undermine the legitimate operation of this Giveaway may be a violation of criminal and civil law, and should such an attempt be made, Ziggi’s reserves the right to seek damages and other remedies (including attorney’s fees) from any such person to the fullest extent permitted by law.

All decisions made by Ziggi’s are final. Ziggi’s reserves the right to terminate, modify, or suspend the Giveaway as it sees fit and to pick from other eligible entries if necessary.

Information submitted in connection with this Giveaway will be used in accordance with Ziggi’s Privacy Policy, available at www.ziggiscoffee.com/privacy-policy.

FORCE MAJEURE: Ziggi’s is not responsible for any interruption or cancellation of the Giveaway due to unforeseen circumstances beyond its control, including but not limited to natural disasters, pandemics, or government restrictions.

GOVERNING LAW/JURISDICTION: This Giveaway and the rights and obligations of Ziggi’s and participants will be governed by and construed in accordance with the laws of the state of Colorado, without regard to its conflict of law principles. Any disputes arising out of or connected with this Giveaway shall be resolved exclusively by the courts located in Colorado.

RELEASED PARTIES: Entrants, by participating, agree that Ziggi’s, and their respective parents, affiliates, subsidiaries, and advertising and promotion agencies, and all of their respective officers, directors, employees, representatives, and agents (collectively, “Released Parties”) will have no liability whatsoever for, and shall be held harmless by entrants against, any liability for any injuries, losses, or damages of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse, or use of the prize or participation in this Giveaway.
