By participating, entrants agree to be bound by these Giveaway Rules and the decisions of the Ziggi’s Coffee Franchise, LLC, a Colorado limited liability company (“Ziggi’s”), which are binding and final on matters relating to this giveaway (the “Giveaway”). This Giveaway is subject to all applicable federal, state and local laws.
ELIGIBILITY. Open only to legal residents of all states where Ziggi’s is sold, who are 18 year of age and older and of legal age of majority in their state of residence. Employees of Ziggi’s and any affiliate of Ziggi’s are not eligible for entry.
TO ENTER. To enter for a chance to win, you must follow the instructions in the applicable post made by the @ziggis_coffee Instagram account (the “Giveaway Post”). A Giveaway Post will include how to enter, the entry deadline, and the prize(s)/value(s). In any Giveway in which an Instagram user must “like” an applicable post by @ziggis_coffee, follow @ziggis_coffee, and/or tag friends in the comment section on any Giveway Post, the entrant must maintain the condition of entry at least until the time a winner is announced to be eligible to win the Giveaway. All information contained in a Giveaway Post is incorporated herein by reference. Entries must be received within the entry period’s start and end times to be eligible, and all conditions of entry must be maintained until the winner announcement date. and The Giveaway winner’s valid U.S. shipping address must be received within five (5) days of notification, through Instagram direct messaging, of a winner. There is no limit on entries per person/per Instagram account for the duration of the Entry Period. Multiple entries will not increase your chances of winning. Entries generated by script, macro or other automated means or by any means which subvert the entry process are void. All entries become the property of Ziggi’s and will not be acknowledged or returned. If you do not have an Instagram account, establishing an account is free. Entry must not defame or violate or infringe upon the rights of any person or entity.
ENTRY PERIODS/DRAWINGS. RANDOM DRAWINGS: ONE (1) POTENTIAL WINNER WILL BE SELECTED IN A RANDOM DRAWING FROM ALL ELIGIBLE ENTRIES RECEIVED FOR GIVEAWAY PERIOD.
NON-WINNING ENTRIES WILL NOT BE CARRIED OVER INTO SUBSEQUENT GIVEAWAYS. ODDS OF WINNING A GIVEAWAY DEPENDS ON THE NUMBER OF ELIGIBLE ENTRIES RECEIVED BY THE END OF ENTRY PERIOD. A POTENTIAL WINNER WILL BE NOTIFIED BY ZIGGI’S TAGGING THE SELECTED WINNER IN ZIGGI’S PUBLIC COMMENT SECTION OF THE POST. ZIGGI’S MAY REQUEST PROOF OF ELIGIBILITY AND VALID U.S. SHIPING ADDRESS THEREAFTER. ALL INFORMATION PROVIDED TO ZIGGI’S IS SUBJECT TO ZIGGI’S PRIVACY POLICY, AND BY PROVIDING SUCH INFORMATION TO ZIGGI’S, A ENTRANT IS AGREEING TO THE TERMS AND CONDITIONS THEREOF. IF A WINNER IS FOUND TO NOT BE ELIGIBLE, ZIGGI’S MAY, IN ITS SOLE DISCRETION, AWARD A NEW WINNER OR NO WINNER. DECISIONS OF THE ZIGGI’S ARE FINAL.
GENERAL CONDITIONS. Released Parties (as defined below) are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered, or garbled, Entries for whatever cause or other errors whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Giveaway. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Giveaway. Released Parties are not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Giveaway or downloading materials from or use of the web site. Persons who tamper with or abuse any aspect of the Giveaway or website, who are in violation of these Rules, as solely determined by Ziggi’s, will be disqualified and all associated entries will be void. Should any portion of the Giveaway be, in Ziggi’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Ziggi’s, corrupt or impair the administration, security, fairness or proper play, or submission of Entries, Ziggi’s reserves the right at its sole discretion to suspend, modify or terminate the Giveaway and, if terminated, at its discretion, select the potential winner from all eligible, non-suspect Entries received prior to action taken using the judging procedure outlined above. Information submitted in connection with this Giveaway will be used in accordance with Ziggi’s Privacy Policy, available at www.ziggiscoffee.com/privacy-policy/.
Entrants, by participating, agree that Ziggi’s, Instagram, and their respective parents, affiliates, subsidiaries and advertising and promotion agencies and all of their respective officers, directors, employees, representatives and agents (collectively, “Released Parties”) will have no liability whatsoever for, and shall be held harmless by entrants against, any liability, for any injuries, losses or damages of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the prize or participation in this Giveaway. In the event of a dispute regarding entries received from multiple users having the same Instagram account, the authorized subscriber of the Instagram account at the time of entry will be deemed to be the entrant and must comply with these rules.
LIKENESS, NAME AND IMAGE. For one (1) year beginning the date the Giveaway is announced, the winning entrant grants Ziggi’s the right to publish winner’s real name, Instagram handle, likeness and state of residence in connection with the Giveaway, which may be used in a separate post from the Giveaway Post. Ziggi’s may use winner’s name and likeness solely for promotional purposes, without notice or further compensation, except where prohibited by law.
